Derivative Work

A “derivative work”, depending on jurisdiction, is generally defined as a work based upon one or more preexisting works, such as a translation, musical arrangement, dramatization, fictionalization, motion picture version, sound recording, art reproduction, abridgment, condensation, or any other form in which a work may be recast, transformed, or adapted. The new work arises—or derives—from the previous work, and may in of itself constitute a new expressive creation that incorporates or includes copyrightable elements of the original work.
